Trademark Registration in Afghanistan

Registering a trademark is the best way to protect your rights in Afghanistan. As the market continues to grow, registration offers stronger legal protection and helps prevent misuse.

The official fees for the new trademark registration described stage by stage.

Requirement:

• a) A power of attorney, duly notarized and legalized up to the Afghanistan Consulate;
• b) Name, legal status and address of the applicant;
• c) A list of good/services and Class(s) thereof to be protected under the trademark (as per the latest Edition of Nice Classification);
• d) A clear print of the trademark in JPG format (not required for word marks).

Registration Procedure:

A trademark application will undergo examination and publication in the Official Gazette before its registration. Since it cannot be completely predicted the compeletion time but our practices shows that the timeframe for a trademark registration will be from 6-9 months.

Single Class Application

The Afghanistan Trademark Office has adopted single class registration system with effect from 2016; hence a separate application should be filed for each class of goods or services.

Priority Claim:

Claiming priority is possible under Paris Convention, for which a certified and legalized copy of the priority document is required.

Note:
