Trademark Applications requirements in Afghanistan

Filing a New Trademark Application is easy and straight forward which require the following:

• Aut Name, Address and the Legal Status of the Applicant in English
• A list of the goods/services and the corresponding class(s), as per the latest edition of the Nice Classification
• A Power of attorney duly notarized and legalized up to the Afghanistan Consulate; and
• Prints of the trademark.

Note: The list of goods/services shall be based on the latest edition of the NICE classification

Filing a Renewal Application for a Registered Trademark in Afghanistan requires the following.

• A Power of attorney duly notarized and legalized up to the Afghanistan Consulate,
• A copy of the registration and/or latest renewal certificate,
• A clear copy of the image for device mark not for work.

Note: The Renewal Application can be filed six months before the Renewal due date.

Filing a Change of Name Application is only possible for a Registered Mark which requires the following.

• A Power of attorney duly notarized and legalized up to the Afghanistan Consulate,
• A copy of the registration and/or latest renewal certificate,
• A Change of Name document duly Notarized and Legalized up to Afghan Consulate,
• A clear copy of the image for device mark not for work.

Note: Any Changes in the ownership must be recorded immediately for all Trademarks falling under the same owner. Based on the current practices of the Afghanistan Trademark Office (ATO).

Filing a Change of Address Application is only possible for a Registered Mark which requires the following.

• A Power of attorney showing the new address duly Notarized and Legalized up to the Afghanistan Consulate,
• A copy of the registration and/or latest renewal certificate,
• A clear copy of the image for device mark not for work.

Note: Any Changes in the ownership must be recorded immediately for all Trademarks falling under the same owner, Based on the current practices of the Afghanistan Trademark Office (ATO).

Filing a Change of Name & Address Application is only possible for a Registered Mark which requires the following.

• A Power of attorney duly Notarized and Legalized up to the Afghanistan Consulate,
• A copy of the registration and/or latest renewal certificate,
• A Change of name and Address document duly Notarized and Legalized up to Afghan Consulate,
• A clear copy of the image for device mark not for work.

Note: Any Changes in the ownership must be recorded immediately for all Trademarks falling under the same owner, Based on the current practices of the Afghanistan Trademark Office (ATO).

Filing an Assignment Application is only possible for a Registered Mark which requires the following.

• A Power of attorney in the name of Assignee duly Notarized and Legalized up to the Afghanistan Consulate,
• A copy of the registration and/or latest renewal certificate,
• A Deed of Assginment document duly Notarized and Legalized up to Afghan Consulate,
• A clear copy of the image for device mark not for work.

Note: Based on the current practices of the Afghanistan Trademark Office (ATO) one or all the trademarks of an owner can be assigned to another party.

Filing a Merger Application is only possible for a Registered Mark which requires the following.

• A Power of attorney duly Notarized and Legalized up to the Afghanistan Consulate,
• A copy of the registration and/or latest renewal certificate,
• A Merger document duly Notarized and Legalized up to Afghan Consulate,
• A clear copy of the image for device mark not for work.

Any Changes in the ownership must be recorded immediately for all Trademarks falling under the same owner, Based on the current practices of the Afghanistan Trademark Office (ATO).

Filing a License Agreement Application is only possible for a Registered Mark which requires the following.

• Powers of attorney from the Licensee duly notarized and legalized up to the Afghanistan Consulate,
• A copy of the registration and/or latest renewal certificate,
• A License Agreement executed between the Licensor and the Licensee duly notarized and legalized up to the Afghanistan Consulate,
• A clear copy of the image for device mark not for word mark.
